AGREEMENT TO OUR LEGAL TERMS

We are Today is Tomorrow LLC ("Company," "we," "us," "our"), a company registered in the United States at 41 STATE STREET, SUITE 112, ALBANY, NY, 12207.

We operate the website https://aurafarming.club (the "Site"), the mobile application AuraFarm.club (on iOS and Android) (the "App"), as well as any other related products and services that refer or link to these legal terms (the "Legal Terms") (collectively, the "Services").

We reserve the right, in our sole discretion, to make changes or modifications to these Legal Terms from time to time. We will alert you about any changes by updating the "Last updated" date of these Legal Terms, and you waive any right to receive specific notice of each such change. It is your responsibility to periodically review these Legal Terms to stay informed of updates.

The Services are intended for users who are at least 16 years of age. All users who are minors in the jurisdiction in which they reside (generally under the age of 18) must have the permission of, and be directly supervised by, their parent or guardian to use the Services. If you are a minor, you must have your parent or guardian read and agree to these Legal Terms prior to you using the Services.

1. OUR SERVICES

The information provided when using the Services is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation. Accordingly, those persons who choose to access the Services from other locations do so on their own initiative and are solely responsible for compliance with local laws.

The Services are not tailored to comply with industry-specific regulations (Health Insurance Portability and Accountability Act (HIPAA), etc.), so if your interactions would be subjected to such laws, you may not use the Services.

2. INTELLECTUAL PROPERTY RIGHTS

We are the owner or the licensee of all intellectual property rights in our Services, including all source code, databases, functionality, software, and content. The Content and Marks are provided in or through the Services "AS IS" for your personal, non-commercial use only. Any breach of these Intellectual Property Rights will constitute a material breach of our Legal Terms and your right to use our Services will terminate immediately.

3. USER REPRESENTATIONS

By using the Services, you represent and warrant that: (1) all registration information you submit will be true, accurate, current, and complete; (2) you have the legal capacity and you agree to comply with these Legal Terms; (3) you are not under the age of 16; (4) you will not access the Services through automated or non-human means; (5) you will not use the Services for any illegal or unauthorized purpose; and (6) your use of the Services will not violate any applicable law or regulation.

4. USER REGISTRATION

You will be required to register to use the Services. You are responsible for all activities that occur under your account and for maintaining the security of the sign-in methods you use to access the Services (such as your Apple ID, Google account, or mobile device).

5. SUBSCRIPTIONS AND AUTOMATIC RENEWAL

Certain features of the Services are available only with a paid subscription. If you choose to purchase a subscription, the following terms apply:

5.1 Payment & Billing

All subscription purchases are processed directly through your mobile app store account (Apple App Store or Google Play Store). By purchasing a subscription, you authorize the applicable App Store to charge your designated payment method for the full amount of the subscription fee plus any applicable taxes.

5.2 Automatic Renewal

The renewal charge will occur within 24 hours prior to the end of the current period. The cost of the renewal will be the then-current price of the subscription plan you selected.

5.3 Free Trials

If you sign up for a free trial, YOU WILL BE AUTOMATICALLY CHARGED the applicable subscription fee at the end of the trial period unless you cancel your subscription at least 24 hours before the trial ends. If you cancel before the trial ends, you will not be charged. You may only use one free trial per account.

5.4 Cancellation Policy

You may cancel your subscription at any time. CANCELLING A SUBSCRIPTION DOES NOT TRIGGER A REFUND for time already used. If you cancel, your subscription will remain active until the end of the current paid period, after which it will expire and you will not be charged again.

• To Cancel on iOS: Go to Settings > [Your Name] > Subscriptions > AuraFarm.club > Cancel Subscription.
• To Cancel on Android: Open Google Play Store > Tap Profile Icon > Payments & subscriptions > Subscriptions > AuraFarm.club > Cancel Subscription.

5.5 Price Changes

We reserve the right to change our subscription prices at any time. If we increase the price, the App Store or Google Play will notify you in advance and may require your agreement to the new price. If you do not agree, your subscription will expire at the end of the current term.

6. REFUNDS

Because our Services are purchased through third-party app stores (Apple App Store and Google Play Store), WE DO NOT HAVE THE ABILITY TO ISSUE REFUNDS DIRECTLY. All refund requests must be submitted to the store where you made the purchase, and are subject to that store’s refund policy.

• Google Play Store: Visit the Google Play Help Center to request a refund.

7. PROHIBITED ACTIVITIES

You may not access or use the Services for any purpose other than that for which we make them available. As a user, you agree not to engage in activities such as reverse-engineering the app, systematically retrieving data, harassing other users, or interfering with the proper working of the Services.

8. SERVICES MANAGEMENT

We reserve the right, but not the obligation, to monitor the Services for violations of these Legal Terms and to take appropriate legal action against anyone who violates the law or these terms.

9. PRIVACY POLICY

We care about data privacy and security. Please review our Privacy Policy. By using the Services, you agree to be bound by our Privacy Policy, which is incorporated into these Legal Terms.

10. TERM AND TERMINATION

These Legal Terms shall remain in full force and effect while you use the Services. We reserve the right to deny access to and use of the Services to any person for any reason, including for breach of any representation, warranty, or covenant contained in these Legal Terms.

11. MODIFICATIONS AND INTERRUPTIONS

We reserve the right to change, modify, or remove the contents of the Services at any time. We cannot guarantee the Services will be available at all times and may experience interruptions, delays, or errors.

12. GOVERNING LAW

These Legal Terms shall be governed by and defined following the laws of the State of New York, USA. Today is Tomorrow LLC and yourself irrevocably consent that the courts of Albany, New York shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these Legal Terms.

13. DISPUTE RESOLUTION

To expedite resolution and control the cost of any dispute, the Parties agree to first attempt to negotiate any Dispute informally for at least thirty (30) days. If unresolved, any dispute shall be referred to and finally resolved by binding arbitration in Albany, New York, in accordance with the rules of a recognized arbitration body such as the American Arbitration Association.

14. DISCLAIMER

THE SERVICES ARE PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. YOU AGREE THAT YOUR USE OF THE SERVICES WILL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SERVICES AND YOUR USE THEREOF.

15. LIMITATIONS OF LIABILITY

IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE SERVICES.

16. INDEMNIFICATION

You agree to defend, indemnify, and hold us harmless from and against any loss, damage, liability, claim, or demand, including reasonable attorneys’ fees and expenses, made by any third party due to or arising out of your use of the Services or breach of these Legal Terms.

17. USER DATA

We will maintain certain data that you transmit to the Services for the purpose of managing the performance of the Services. Although we perform regular backups, you are solely responsible for all data that you transmit. You agree that we shall have no liability to you for any loss or corruption of any such data.

18. MISCELLANEOUS

These Legal Terms and any policies posted by us on the Services constitute the entire agreement between you and us. If any provision is determined to be unlawful, void, or unenforceable, that provision is deemed severable and does not affect the validity of any remaining provisions.
